About the Library and its Community

The Floyd County Library serves approximately 77,000 residents of Floyd County, Indiana and reciprocal borrowers from the state of Indiana.

The Library’s goal is to provide a diverse Floyd County community with materials that reflect a wide range of views, expressions, opinions, and interests. Curating and maintaining a diverse and equitable collection is an ongoing process which is considered in collection development and materials selection.

General Criteria for Selection of Materials

The following criteria are used to determine materials to be added to the Library’s collection. An item does not need to meet every criterion to be added.

·         Public demand, usefulness, and appeal

·         Reflection of the diverse population of our area and our global society

·         Contribution to the diversity and scope of the collection

·         Contemporary significance, popular interest, or permanent value

·         Reviews in professionally recognized resources

·         Nominations for awards

Selection of materials may be influenced by many factors, including but not limited to the following:

·         Budgetary considerations

·         Physical space limitations

·         Suitability of the format and construction

·         Availability of materials in other local libraries and libraries accessible through the SRCS lending program

As new formats emerge, steps will be taken to phase out duplicated, obsolete mediums.

Responsibility for Selection and Suggestions for Purchase

Selection for the Library’s collection is a collaborative effort spearheaded by the Collection Development Leader. Patrons are welcome to make suggestions for purchase by filling out the Suggestion for Purchase form on our website. Suggestions for purchase and/or preview copies provided by authors are subject to the same selection criteria as other items and are not automatically added to the collection. Preview copies that are not added to the collection will be donated to nonprofit organizations.

Interlibrary Loan through the SRCS lending program is both a public service and an integral element in the Collection Development process. Staff may consider purchasing an item in lieu of requesting it through SRCS if the material is new, requested frequently, and/or deemed appropriate for selection based on the criteria for selection.

Collection Maintenance

The purpose of the Library collection is to provide materials that are in demand by the community, not to serve as an archive or an institute for advanced scholarly research. The Library keeps its collection vital and useful by removing, on a systematic and ongoing basis, those works that are worn, outdated, or no longer in demand. A goal of the Library is to keep the average age of the collection within 10 years of the current year.

Gifts

The Friends of the Floyd County Library gratefully accepts donations of gently used materials. No conditions may be imposed relating to any materials donation. Funds generated by the Friends of the Library support library services and programs. Unsold materials will be donated to nonprofit organizations.

Monetary memorial donations may be utilized for a variety of material formats and may be designated to youth or adult collections.

Request for Reconsideration

A Floyd County resident may request the reconsideration of an item already in the library’s collection. To request reconsideration of an item, please fill out the request for reconsideration form. Until a decision is reached, the item will remain in the collection. The final responsibility for reconsideration rests with the Library’s leadership team.

Click here for the request for reconsideration form. This is a fillable PDF, so you will need to fill it out and save the file before you close it.

Scope of the Branch Libraries

The Galena Digital Branch has a very limited physical collection of materials and focuses on providing access to technology and materials that are available digitally. A small circulating collection of physical materials is available at the branch and patrons may choose to have books from the Central Library delivered to the Branch for pickup.

The Carnegie Center for Art and History, a branch of the library, has a small collection of materials related to its exhibits and activities.

New Albany-Floyd County Public Library Special Collections Policy

Purpose

In accordance with our mission and strategic plan, the New Albany-Floyd County Public Library (hereafter referred to as the Library) collects, preserves, and provides access to historical collections and works of art significant to Floyd County. The purpose of this policy is to define the scope of the Library’s Special Collections across all branches and to guide the Library in the acquisition and disposition of its permanent collection.

Collection Scope

The Library’s Special Collections, which include all branches, consist of non-circulating materials of historical or artistic value that require specialized, ongoing stewardship, due to their format, condition, or rareness. Materials are primarily related to Floyd County, or the land currently occupied by Floyd County, from any time period. General histories of Indiana and published materials of genealogical significance from locales outside of Floyd County may be collected based on community needs.

When selecting items for the Special Collections, the Library considers the following criteria:

  • Relevance to Floyd County and regional history
  • Enduring historical value or artistic merit
  • Representation of diverse viewpoints, expressions, and interests reflected by the community
  • Authenticity and provenance
  • Moral, legal, and ethical implications
  • The Library’s ability to preserve, store, provide access to, and display the item(s)
  • Relation to the existing collection
  • Access and disposition restrictions by donor

Materials Included:

The Library collects materials in a variety of formats, including print, audiovisual, and digital. Collections include but are not limited to books, indexes, family histories, vital records, yearbooks, city directories, periodicals, archives, personal papers, correspondence, diaries, genealogical research, government records, local business and organization records, maps, ephemera, photographs, microfilmed newspapers, oral histories, videos, sound recordings, electronic materials, paintings, drawings, and prints.

Three-dimensional artwork and artifacts are accepted on a limited basis, at the discretion of Library staff. The Library does not collect newspapers in their original format or family bibles (except family record pages).

Means of Acquisition

Materials may be acquired by purchase, commission, gift, bequest, field collection, transfer, or abandonment. In most cases, a deed of gift must be signed to transfer ownership to the Library.

Reappraisal and Deaccessioning

From time to time, the Library’s Special Collections will be reevaluated based on the above selection criteria, and the deaccession of some materials may take place. Deaccessioned items may be given to other institutions, returned to the donor, sold at Friends of the Library books sales, or otherwise discarded at the discretion of Library staff.

Acceptable Use Policy of the Library’s Internet Access & Electronic Equipment

The New Albany-Floyd County Public Library provides Internet access for any legal, educational, recreational or ethical purpose. Internet workstations are limited to two users seated per workstation. In addition, the Library provides electronic devices that can be checked out for use in the Library.

Users will not:

  • Engage in illegal activity
  • Violate any laws of the United States, State of Indiana, Floyd County or the City of New Albany
  • View obscenity
  • Harass or violate the privacy of others
  • Display, view, or print any images harmful to minors
  • Save documents to the hard drive
  • Install applications or Internet plug-in applications
  • Attempt to modify, abuse, or harm the computer in any way
  •  Use any website or application to bypass the library’s internet safeguards
  • Physically plug any personal equipment into the library’s network or equipment for any reason.
  • Headphones, flash drives or external hard drives are permissible.

Users accept that by asking for staff assistance will result in exposure of content by the assisting staff member.

The Library reserves the right to suspend or revoke use of the Library computer systems or devices at any time, without prior notice or formal hearing, for any user for abusive conduct or violation of the conditions set forth in this document. The Library will be the sole arbitrator of what constitutes abusive conduct or violation of this Acceptable Use Policy. Library staff have the discretion to issue warning(s) or to ask the offender to leave or call the proper authorities.

The Library reserves the right to inspect or observe the use made of its equipment and resources for the purpose of enforcement of these policies. Any user who violates federal, state, or local laws will be prosecuted to the full extent of the law. Evidence of illegal activity will be reported to the proper legal authorities. The library will cooperate with the proper authorities in the investigation of illegal activities.

Children’s and Teen’s computers are restricted for youth.  However in accordance with the Library’s Safety Policy for Children, an adult with a child may use an available computer in the Children’s area.

Any damage to the equipment caused by improper care, roughness, or vandalism will be the responsibility of the user, and that user will bear the cost of any needed repairs and/or replacement of components or parts as a result of such damage.

Internet Filtering
All library computers, laptops and networks are filtered in the spirit of the Children’s Internet Protection Act of 2001 (CIPA). Under CIPA, the following are NOT protected by the First Amendment of the U.S. Constitution: Child pornography, Obscenity, and Visual depictions harmful to minors

Although the Library filters all Internet traffic, not every web page has been categorized and therefore the Library cannot be held responsible for material downloaded from the Internet. The Library does not act “in Loco Parentis” and therefore parents or legal guardians are ultimately responsible for their children’s use of the Internet.

Usage of the Library’s wireless access is held to all above conditions and acceptable use policies set forth by the governing Library Board of Trustees.

Reviewed & Updated by the New Albany Library Board of Trustees, August 7, 2023.

The New Albany-Floyd County Public Library (“NAFC Public Library”) subscribes to the American Library Association (“ALA”) Code of Ethics (Article III) which states:

“We protect each library user’s right to privacy and confidentiality with respect to information sought or received and resources consulted, borrowed, acquired or transmitted.”

The NAFC Public Library Board of Trustees previously adopted a resolution (Res. adopted 1/6/2000) establishing a policy regarding access to public records, and excepting certain library records from disclosure pursuant to Indiana Code 5-14-3 et seq. The following Privacy Policy shall work in conjunction with that previously stated Public Records Policy.

1. Confidentiality of Library Records

In keeping with the ALA’s Policy on Confidentiality of Library Records (1986) and Policy Concerning Confidentiality of Personally Identifiable Information About Library Users (1991), NAFC Library staff will not respond to any informal request by a third party for personally identifiable information about any library user. Such information includes database search records, reference interviews, e-mail requests for information, circulation records, interlibrary loan records, and other personally identifiable uses of library materials, facilities or services.

Personally identifiable information may be released only to a law enforcement agency after presentation of an order by a court of competent jurisdiction issues in proper form (a legal subpoena or search warrant) that shows good cause based on specific facts. The general procedures for complying with law enforcement officials are outlines in Section 4, below.

2. Personally Identifiable Information

NAFC Public Library staff will only collect information needed to contact library users, such as mailing address, e-mail address, phone number, etc., in order to ensure the proper notification, lending, and return of library materials and the collection of fines. Records will be retained for the shortest length of time necessary to facilitate library operations. Paper copies containing personally identifiable information will be disposed of in a secure manner on a regular basis.

3. Access to Electronic Resources and Web Server Usage Tracking

NAFC Public Library has or may in the future have electronic resources that can be accessed from anywhere by anyone. System administrators at NAFC Public Library may track the usage of our website and other library systems and services accessed through our servers. Information may be collected about the date and time visited, the type of browser and computer operating system used by visitors, their Internet service provider and IP address, search terms used and links followed, and the sequence of pages visited on our site. This transaction history log will not be stored in such a way as to identify particular library users and the information they access, but is to be aggregated for multiple users and maintained to generate statistics about our Web site.

Another common type of usage tracking relies on the use of a software application called “cookies.” Users of networked computes must enable cookies in order to access a number of online resources. A cookie is a small file sent to the browser by a Web site each time that site is visited. Cookies are stored on the user’s computer and can potentially transmit personal information. NAFC Public Library servers may use cookies, but only to verify that a person is an authorized user in order to allow access to licensed library resources and to customize Web pages to that user’s specification.

4. Procedures for Handling Requests for Library Records

Library staff who are approached by a law enforcement official with any subpoena, search warrant, or court order to examine or obtain the library record of any library user will state that the library has a written privacy policy. In accordance with NAFC Public Library Procedures, the library staff will immediately direct the agent to the office of the Library Director or a manager. Legal counsel will review the order to ascertain that it is in proper form, and advise the library staff about complying with the terms of the order.

Search warrants signed by the Court are immediately enforceable. The officer or agent will be asked to allow the director and legal counsel to review the search warrant prior to the inspection of records. If the agent will not accord this time for review and proceeds with a search, the library staff will obtain a copy of the search warrant and the agent’s identification information and will not interfere but will advise the Director appropriately.

The 2001 USA PATRIOT Act (“Act”) expands federal law enforcement’s surveillance, seizure and investigative powers. If library records (including information abut material borrowed and computer usage are requested under the Act, the law states that, in certain circumstances, library staff cannot inform the person about whom the information is requested, cannot speak to coworkers, the media or other government officials about the inquiry. Such requests may only be reported to the appropriate higher authority within the library.

For Further Information

Links to useful resources on privacy and confidentially are maintained by the ALA on its Privacy Resources for Librarians, Library Users, and Families page.

Access to public records is governed by Indiana Code 5-14-3. The official policy of the State of Indiana is that all persons are entitled to full and complete information regarding the affairs of government and the official acts of those who represent them as public officials and employees, subject to certain limitations.

The New Albany-Floyd County Public Library holds three types of records: 1) general records; 2) work records; and 3) patron information. Different criteria govern access to each of the general types of records.

Public Records

The Library is required by law to make available all records of its affairs and the official acts of those who represent the Library not specifically excepted. Any person may inspect and copy non-excepted public records held by the Library during regular business hours. The request must be made in writing allowing the Library minimally one full business day notice, if delivered in person, or seven business days after receipt, if delivered by mail, and must “identify with reasonable particularity the record being requested

[IC 5-14-3-3(a)(1); IC 5-14-3-9]. A staff person must be present during the inspection to ensure the integrity of the record. Copies made using the Library’s equipment are assessed charges at the current rate of charges for public access photocopiers as established by the Library Board of Trustees. The Library is not obligated by law to create a document that it does not already have on file to fill an informational request.

Public Records Excepted from Disclosure

Public records excepted from disclosure include:

  •  Personnel files of library employees and files of applicants for employment as described under the Library’s Personnel policies;
  • Records specifically prepared for discussion or developed during a discussion in an executive session under IC 5-14-1.5-6;
  • The identity of a donor or a gift if the donor required nondisclosure of its identity as a condition of making the gift; or after the gift is made, the donor, or the donor’s family, requests nondisclosure.

Work Records Excluded from Disclosure

Work records excluded from disclosure include:

  •  Administrative or technical information that would jeopardize a recordkeeping or security system
  • Computer programs, computer codes, computer filing systems, and other software owned by the Library or entrusted to it
  • Any record declared confidential by State statute or Federal law.

Patron Records

The Library takes very seriously its obligations to protect the privacy of every person. Any information the Library maintains on patrons and their use is deemed private and confidential [IC 5-14-3-4 (b) and IC 5-14-3-4 9b) (16)].

Further, the Board subscribes to the American Library Code of Ethics, which says in part that “We protect each library user’s right to privacy and confidentiality with respect to information sought or received and materials consulted, borrowed, acquired or transmitted.”

The Library may use such records for its own purposes and needs, including, but not limited to: for claims against library patrons for collection of fines, materials, and other expenses; in any litigation wherein an attorney representing the Library deems the records material evidence; and/or in collection development. Library staff members are not authorized to disclose such records to any third party, except for disclosure to a parent or guardian, information on their minor children, if they ask. The only other release of patron records will be by the order of a court or grand jury.

This policy shall not be construed as a guarantee by the Library to its patrons of any absolute right to privacy. The Library is not responsible for information gained from a patron record by anyone other than the patrons, if the patron has lost or loaned his/her card or if someone has obtained the patron information by illegal or inappropriate methods. However, records of minors can be disclosed to their parents, stepparents, or legal guardians with proper identification.

All of the Library’s records are available, without exception, to the officers and members in good standing, of the New Albany-Floyd County Public Library’s Board of Trustees, who are still bound by the above confidentiality laws.

Copyrights
Patrons are responsible for abiding by U.S. Copyright law (Title 17, U.S. Code), which governs copying, displaying, or distribution of copyrighted material, except by the concept of “fair use” (Sect. 107).

Disclaimer
